Naples Man Files Lawsuit After E-Cigarette Explodes reports on an incident in which a Naples man suffered burns and other injuries after an e-cigarette exploded in his home. According to Naples Daily News, the man has now filed a lawsuit against the manufacturer claiming that the risks should have been made clearer and the company should have designed the device in a way that prevented the device from overheating.

His is not the first lawsuit to be filed in relation to exploding e-cigarettes. A similar lawsuit was filed in Queens after an e-cigarette exploded in a woman’s car and left her with severe burns. She said she plans to sue the battery manufacturer as well as the shop where she bought it. The woman is being represented by Attorney Marc Freund with Lipsig, Shapey, Manus & Moverman, P.C.

"You go into a store, you're not dealing with the manufacturer, you're dealing with the retailer. They have a responsibility for public's safety," said Freund in an interview with NBC.

Recently, the FDA has announced that they will now be regulating the devices. According to FEMA, there have been 25 e-cigarette explosion incidents reported in the U.S. between 2009 and 2014 but the numbers are expected to be higher based on the amount of incidents that go unreported. The explosions occur while the devices are charging in about 80 percent of incidents but have also exploded in a handful of cases where the devices were in use. In some cases, the e-cigarette explosions have caused severe burns and blunt force trauma as well as emotional trauma.

Lipsig, Shapey, Manus & Moverman are currently looking to assist those who have been affected by explosive e-cigarettes.
