Judge to young couple: Get married or boyfriend goes to jail

Marriage is a big choice for any man or woman, but for Josten Bundy and his girlfriend Elizabeth Jaynes the decision had been taken out of their hands. Smith County Judge Randall Rogers recently decreed that Bundy will either marry his girlfriend within 30 days or spend 15 days in jail.

Bundy had the difficult choice forced upon him after he got into a fight with Ms. Jaynes ex-boyfriend. Apparently the ex was insulting Jaynes and Bundy decided to take actions into his own hands, something he later regretted and apologized for.

Bundy pled guilty on July 2, with the fight having occurred back in February.

Following the scuffle Bundy was charged with misdemeanor assault and forced to appear in court. At first, Bundy was fine with being sent to jail, but asked that he be given an opportunity to inform his employer, a request that the judge denied.

The judge then forced Ms. Jaynes to stand up in court, drawing laughter from the audience.

Bundy and Jaynes decided to go forward with the wedding, but both were disappointed over the haphazard ceremony. The two obtained a marriage license and were married by a justice of the peace, but noted that owing to the last minute preparations, many family members were unable to attend.

Jaynes noted that she wasn’t even wearing the traditional white dress during the ceremony.

Lawyers are now questioning the legality of the ruling, noting that judges are generally not granted authority over such personal choices. So far, Judge Rogers has refused to defend or answer questions on his ruling.

Bundy’s probation also calls for him to write out bible verses, a Constitutionally questionable punishment given the strict legal interpretations of the separation of church and state.
