Alleged intruder slain, Second Amendment used

The Calaveras Sheriff Department released information today on the June 28 incident which resulted in the death of an alleged intruder to an Angels Camp residence. The intended victim of the intrusion attempt is Derek Rutherford, a 29 year-old resident living in the 6000 block of Chaparojos Street, Angels Camp. The intruder was reportedly attempting to enter the residence while threatening to kill Rutherford.

During the altercation at the home and before Ronald Richard Farmer II was able to gain entry to the home, a female, who remains unidentified, drove up to the residence. At that time, as reported at MML, Farmer made a threat to Rutherford, stating that he (Farmer) would kill the female. Derek Rutherford had already armed himself with a pistol due after Farmer allegedly made threats.

When the 26-year-old Tuolumne City resident Ronald Farmer II allegedly threatened the female, Rutherford stepped outside the home and reportedly shot Farmer multiple times. According to the Calaveras Sheriffs Department, Farmer was pronounced deceased at the scene by emergency medical responders.

The investigation into the incident is continuing, and undoubtedly more information will be released by the Calaveras Sheriff when the findings are verified.

Rutherford was released after being questioned by the Sheriff’s Department. Farmer’s motives have not been released to the public yet. Until that happens, no determination regarding the alleged victim and any responsibility he may have in the situation can be made.

In this case, some citizens might suggest the Second Amendment served the alleged victim in the fashion in which it was intended to do. Others will disagree, however, safety and security in and about a citizens home plus the ability to secure the safety of others is one of the reasons the framers of the Constitution wrote the Second Amendment. Not surprisingly, Hillsdale College also has a video presentation by Professor Edward J. Erler of California State University, San Bernardino. The title of the discussion is “The Second Amendment as an Expression of First Principles” and is one point of view in favor of the Second Amendment.
