Oakland County Embezzlement Lawyer Paul J. Tafelski Explains Embezzlement in Michigan

Oakland County embezzlement lawyer Paul J. Tafelski releases a new article (https://www.michigandefenselaw.com/embezzlement) explaining embezzlement in Michigan. The lawyer mentions that criminal charges can lead to anxiety and fear in some people. In some situations, the accused may have committed the crime as a mistake. There are cases in which a person is charged with a crime that they didn’t commit.

“Embezzlement occurs when a person who is entrusted with another party’s money or property steals (or attempts to steal) that money or property. Embezzlement is a lot like theft, but a key element to an embezzlement offense is that the defendant had access to another person’s property or money through a relationship of trust, but did not have ownership of that property or money,” says the Oakland County embezzlement lawyer.

The lawyer explains that if a defendant tries to steal money from someone they trust or know, it could be charged as embezzlement instead of a theft charge. The amount of property or money embezzled may affect the penalty.

Attorney Tafelski mentions that a defendant could face a misdemeanor conviction or a felony conviction. A misdemeanor offense may be charged if someone stole money or property which are valued at less than $200. This can lead to 93 days in jail and/or $500 fines.

According to a Michigan criminal defense lawyer, the severity of the penalties increases with the amount of money or property that is embezzled. A felony is defined as someone who embezzles more than $100,000. This can lead to up to 20 years imprisonment, $50,000 in fines, and/or three times the value of the property.

Furthermore, attorney Tafelski adds that penalties can also increase or previous embezzlement convictions. If the embezzlement affects a non-profit corporation or charitable organization, the punishment may be serious as well.

Lastly, the white-collar crimes lawyer explains that it is important to seek the help of an experienced attorney when facing embezzlement charges. A skilled attorney may be able to help the accused create a defense strategy that may help protect the defendant’s freedom.
