The lawyer explains that New York usually uses a formula to calculate the percentage of the income a parent has to give to the custodial parent. This formula is outlined in the New York Child Support Standards Act.

For a combined income of up to $143,000, both parents are required to pay 17% of the child support. 25% for two children, 29% for three, 31% for four, and at least 35% for 5+ children. If the income of both parents exceeds $143,000, the court may deviate from the standards in the CSSA.

In the article, the lawyer says that typically, the non-custodial spouse will have to pay child support to the custodial parent. One spouse may be required to make child support payments to the other even if they have equal, joint physical custody.

According to attorney Mohr, “Even if your income isn’t from work, it could still be there. New York’s workers’ compensation includes pensions, fellowships, and annuity payments. This income can be used for child support purposes. A court will calculate your payments if you have received disability, unemployment, social insurance, veterans, and retirement benefits. Public assistance is, however, not income. All public assistance received from the state is taken out of the total parental income.”
