Colorado Springs DUI Lawyer Alexis Austin Warns Of Summer DUI Crackdowns

Summer in Colorado Springs is already in full swing and local police are more determined than ever to keep intoxicated drivers off the road.

(PRUnderground) August 19th, 2021

The mild and pleasant summer months of Colorado Springs are already in full swing, and with the state re-opening, more residents than ever are enjoying local libations. However, increased consumption also means that police are more determined than ever to keep intoxicated drivers off the road, according to Colorado Springs DUI lawyer Alexis Austin. Consequently, residents will likely notice an uptick in traffic stops and DUI checkpoints.

Avoid DUI Checkpoints Altogether

Austin warns the public-at-large that this summer there is a greater risk of getting a DUI charge than in preceding years because everyone is wanting to get out after being in the house for so long, but the number of Uber and Lyft drivers is still substantially lower than in years past. “We are all excited to get our social lives back, but we need to make sure safety is our number one priority – that includes ensuring that you do not get a DUI,” says Austin. Further, people should follow the news or social media to keep track of DUI crackdown plans and avoid the roads as much as possible during these times.

DUI testing procedures are inherently flawed and can lead to a false positive for an even sober person. For example, certain health conditions can trigger a blood alcohol content (BAC) result that overstates a person’s level of intoxication.

Colorado DUI Checkpoints

DUI checkpoints are one method of checking for impaired drivers in Colorado Springs. Random testing locations are spotted during major holidays and summer months when consumption of alcohol and marijuana is at its highest. At a DUI checkpoint, police officers can stop drivers and interview them to detect signs of intoxication. Suspicious drivers will face a standardized field sobriety test (SFST).

While drivers give their consent to testing by simply having a valid drivers’ license, strict rules surround the use of DUI checkpoints. The general public has an inherent right to know about them in advance, and evaluation procedures must be free from civil rights violations.

Summer DUI Enforcement

CDOT is reporting that in addition to the Summer Blitz DUI enforcement period earlier this summer, they will be having a Labor Day Crackdown from August 18 through September 6. This is a period of time where law enforcement agencies will be operating with an increased number of officers out in the community looking for signs of impaired driving. During a similar “high visibility enforcement” period over the 4th of July, there were 55 arrests made, and the numbers will likely look similar for this upcoming period.

What Residents Can Do

First and foremost, Ms. Austin cautions people to consume alcoholic beverages and cannabis products responsibly and avoid intoxicated driving altogether. Colorado drivers should also know their legal rights when it comes to traffic stops, sobriety tests, and chemical testing.

DUI stops, tests, and arrests are standardized uniformly throughout the United States. Deviations away from these standards can provide a valid defense to arrestees if they face charges. She further recommends hiring a Colorado Springs DUI lawyer to devise a defensive strategy that challenges the prosecutor’s theory against people who find themselves, unfortunately, dealing with a DUI charge.
