There are two types of surrogacy, each representing the genetic relationship between the surrogate and the child. In traditional surrogacy, the surrogate’s egg is used to create the embryo that she is carrying. In other words, a traditional surrogate is the biological mother of the baby. In gestational surrogacy, the surrogate carries a pregnancy that was created with another woman’s egg. A gestational surrogate shares no genetic material with the baby. In both cases, the sperm can come from any male, donor, or intended parent. According to the CDC (Centers for Disease Control), between 1999 and 2013 about 2% (30,927) of all assisted reproductive technology cycles used a gestational carrier.
Surrogacy is legal in the United States though it is not federally regulated. The laws vary from state to state with states such as Idaho, California, Oregon, Nevada, New Hampshire, New Jersey, Illinois, Maine, Delaware, District of Columbia, Connecticut, and Washington being labeled “surrogacy friendly”. Some states like Wyoming have no regulations and no legal precedents. Some states, like Michigan, impose a prison sentence and a hefty fine for commercial surrogacy. Surrogacy can cost anywhere from $120,000 to $200,000 with the surrogate mother receiving anywhere from $25,000 to $50,000, depending on the state.
Caperton Fertility Institute’s Gestational Carrier Program helps connect healthy and responsible women with those who are struggling to conceive on their own. The program helps interested participants help others grow their families by giving them the gift of parenthood through a purposeful pregnancy.
The program says that for the surrogate’s tremendous act of kindness, the family will generously compensate the participant with a minimum of $25,000 for their time. The family will also cover the expenses for travel, health, insurance, legal fees, and provide the resources to overcome any physical or emotional demands associated with the gestational carrier process.
The institute’s requirements for a participant are that she should be aged between 21 to 39 years, should be a non-smoker, should not partake in recreational drug use, should have a healthy weight with a BMI of less than 28, should have a flexible schedule to meet the demands of the pregnancy, and should have carried a successful pregnancy in the past.
