A couple in Tampa recently went to trial on a complex divorce matter, and the wife sought Christian Denmon's representation to make sure she got a fair settlement.
In this particular scenario, the husband packed up his bags and left the house, leaving his stay-at-home wife of 17 years at home to care for their four minor children. The husband left no support for his family, and stated that he would see his family "on food stamps".
The wife previously sought the services of another lawyer, who suggested that she simply settle for two payments of $4,000 as alimony and support. The wife would agree to no such thing, and decided to call the divorce lawyers at Denmon & Denmon.
The divorce was complicated by the fact that the couple owned seven homes - titled individually, jointly and in the name of a business being operated by the husband. All of these homes were being foreclosed or were severely underwater.
The husband was said to have $16,000 in his 401(k) and IRA, but he apparently withdrew everything after filing for divorce.
At trial, the Judge ordered that the marital home belong to the wife, while all negative equity homes be given to the husband--including those being foreclosed. The Judge also ordered that the husband provide back child support to the amount of over $30,000, as well as child support to the amount of $1,600. The husband is also to give a back payment of $8,000 from the amount removed from his 401(k) after the divorce was filed.
