City of Malibu Adopts Landmark Resolution: Supports Global Phase Out of the Dental Mercury Filling

The Malibu City Council unanimously passed a landmark resolution on Monday, October 10, taking a proactive step by supporting “national and worldwide efforts to reduce anthropogenic sources of mercury,” which is in many products in common use today - including the dental amalgam filling. Dr. and Mrs. James Rota, 30-year Malibu residents, along with Californians for Green Dentistry, contacted the Malibu City Council to express concern regarding awareness of the toxicity of the mercury amalgam "silver" filling.

Mayor John Sibert sponsored the resolution, which was in response to the United Nations Environmental Programme (UNEP) suggestion that cities take an official position in the phase out or global ban of mercury. Malibu is the third city in the United States to do so.

During the City Council Meeting, Mayor Sibert revealed that while conducting environmental studies of soil in Malibu, mercury was found with no apparent source – except that the location in question previously hosted a dental office. Mayor Sibert said that he sponsored the resolution because it is important to send a signal to the legislating bodies, including the United Nations, that cities and their residents are concerned with the toxic effects of mercury in the environment and in our bodies.

“This resolution has a global impact. Concerned dental professionals and consumers have been working for years to ban the use of mercury in dental fillings,” says Dr. James Rota, a Los Angeles biological dentist and educator. Dr. Joseph Sciabbarasi, a Los Angeles holistic doctor, who also attended the Malibu City Council Meeting to show his support for the Malibu Resolution, will also speak at the free seminar regarding mercury toxicity and effective detoxification methods. “Mercury is not a safe filling. Science does not support its safety. It is readily available to poison each of us. That is why I had my mercury fillings replaced years ago,” said Dr. Sciabbarrasi.

“Dental amalgam waste is a significant contributor of mercury discharges to municipal wastewater treatment facilities,” according to the Environmental Protection Agency (EPA). In a recent survey of seven major wastewater treatment plants in California, Minnesota, Ohio, and Maine, dentists were identified as the greatest contributor of mercury.

In efforts to decrease the amount of mercury coming from dental offices, the EPA is considering requiring the use of amalgam separators nationwide. The price range for amalgam separators is $200 - $1200. “There is no financial hardship for a dentist to use an amalgam separator, “ says Dori Rota, a Malibu resident and editor of, a popular resource on the internet regarding mercury toxicity. also contains a directory of dentists around the US and the world who no longer use mercury fillings.

Mrs. Rota further stated, “This resolution is important because it will result in further public awareness regarding the harmful sources of mercury in the environment and the dangerous health risks associated with exposure to this known neurotoxin.” Californians for Green Dentistry is a group of concerned consumers and dental profesionals that have been working with several city governments to increase awareness of the environmental and health issues associated with dental mercury fillings.

Dr. James Rota currently educates dentists how to safely remove mercury fillings, using protocols developed by the International Academy of Oral Medicine and Toxicology (IAOMT). He recently founded the American College of Bio-Compatible Health, which will launch a new website in November 2011, offering Continuing Education courses for dentists and their staff to learn a safer, more biological approach to dentistry.
