C8 Lawsuit Claims Ohio Man Developed Testicular Cancer from C8 Tainted Water Filed by Wright & Schulte LLC

A recent C8 lawsuit was filed on behalf of an Ohio man who developed testicular cancer allegedly from C8 contaminated drinking water, a toxic chemical released from DuPont's Washington Works Plant in Wood County, West Virginia. The C8 lawsuit contends that the 58-year-old Belpre, Ohio, man has lifelong medical injuries as a result of DuPont's negligence in allowing C8 to be emitted into public and private drinking water supplies. This latest C8 lawsuit is similar to dozens of complaints filed against DuPont since April 2013 when a science panel found a potential link between C8, also known as perfluorooctanoic acid, and cancer and other diseases. According to The West Virginia Record (WV Record), the science panel was established as part of a C8 class action lawsuit settlement in 2005. The science panel, assigned to determine the effects of C8, found that exposure to C8 could lead to kidney cancer, testicular cancer, ulcerative colitis (inflammatory bowel disease), pregnancy-induced hypertension (pre-eclampsia), and high cholesterol, the WV Record reported.

As C8 lawsuits against DuPont began to mount, the pending cases from Ohio and West Virginia were transferred and consolidated to the U.S. District Court, Southern District of Ohio. (In re: E.I. du Pont de Nemours and Company C-8 Personal Injury Litigation, MDL 2433) Currently, there are 900 cases pending in MDL-2433. Court records indicate that plaintiffs in the C8 personal injury and wrongful death lawsuits all allege that they ingested the contaminated drinking water released from DuPont's Washington Works Plant in Parkersburg, W. Virginia and suffered from at least one of the diseases identified by the panel. According to the order that consolidated the C-8 cases, the 2005 settlement was between DuPont and a class of about 80,000 people who lived in six water districts allegedly contaminated by C-8 released from the Washington Works plant. The water districts named in the C8 settlement are:

  • Village of Pomeroy, Ohio
  • Little Hocking, Ohio
  • Belpre, Ohio
  • Tuppers Plains, Ohio
  • Mason County Public Service District, West Virginia
  • Lubeck Public Service District, West Virginia

According to the lawsuit filed by the C8 attorneys at Wright & Schulte, LLC, the Belpre, Ohio man is eligible to file a complaint because he lived or worked in the Lubeck Public Service District in West Virginia, one of the six districts named in the settlement, since 1982. The Ohio man's lawsuit contends that DuPont conducted its own research and found C8 was toxic, yet the company continued to release the chemical without putting additional control or abatement equipment in place. According to the lawsuit, which seeks compensatory and punitive damages, DuPont's negligence caused the Ohio man to incur, and will continue to incur, medical expenses due to needing hospital care and related health care services.
