Mirena IUD Lawsuit News: More than 570 Mirena Lawsuits Now Pending in New Jersey Multicounty Litigation, Bernstein Liebhard LLP Reports

Mirena IUD lawsuits ( that allege injuries due to spontaneous migration of the contraceptive device continue to mount in courts around the country, Bernstein Liebhard LLP reports. According to a new Case List issued on February 7, 2014, at least 570 product liability claims have been filed in the multicounty litigation underway in New Jersey’s Bergen County Superior Court on behalf of alleged victims of serious Mirena complications. According to court documents, nearly 100 more claims have been filed in the proceeding since the last update was issued in January. (In Re: Mirena Litigation; Case No. 297)

Mirena Lawsuits
All of the Mirena lawsuits filed in New Jersey were brought on behalf of women who allegedly suffered uterine perforations, pain, scarring, infection, infertility, and other painful Mirena complications after the device spontaneously migrated from its proper position in the uterus. Among other things, the lawsuits accuse Bayer Healthcare Pharmaceuticals of failing to warn of the possibility of spontaneous migration, and note that the product’s label only warns that migration can occur if the uterus is perforated upon insertion.

In addition to the multicounty litigation underway in New Jersey, a multidistrict litigation has been established in the U.S. District Court, Southern District of New York for federally-filed Mirena IUD lawsuits. So far, court documents indicate that at least 344 claims alleging similar injuries have been filed in that proceeding. (In re: Mirena IUD Products Liability Litigation, MDL No. 2434)

Cleared for sale in the U.S. in 2000, the Mirena IUD is now approved as both a method of contraception, and as a treatment for heavy menstrual bleeding for women who wish to use an IUD for birth control. In 2009, Bayer received a warning letter from the U.S. Food & Drug Administration (FDA) that cited the company for making misleading claims about the benefits associated with the device, and downplayed the potential for serious Mirena complications.
