Transvaginal Mesh Lawsuit Update: Bernstein Liebhard LLP Notes Order Designating Vaginal Mesh Lawsuits for Third Round of Trials in American Medical Systems Litigation

The federal multidistrict litigation established in West Virginia federal court for transvaginal mesh lawsuits (http://www.transvaginalmeshlawsuithelp.com/) filed against American Medical Systems is preparing for its third round bellwether trials, Bernstein Liebhard LLP reports. According to an Order issued in the U.S. District Court, Southern District of West Virginia on January 24th, the Court has selected one case for the first trial in that sequence, which is scheduled to begin on August 19, 2014. The Court has also designated a second vaginal mesh lawsuit as a “back-up” if the first selection is unable to proceed to trial for some reason. Court documents indicate that the company’s pelvic mesh devices are the subject of more than 14,000 vaginal mesh lawsuits now pending in the Southern District of West Virginia. All of the complaints allege that the company’s products caused recipients to suffer mesh erosion, organ damage, chronic pain and other serious vaginal mesh complications following surgery to treat pelvic organ prolapse or stress urinary incontinence.
American Medical Systems is just one of several companies named in transvaginal mesh lawsuits pending in the Southern District of West Virginia. Mr. Grand is also serving on the Plaintiffs’ Steering Committees for federal proceedings involving Boston Scientific Corp., (MDL No. 2326); C.R. Bard, Inc., (MDL No. 2187), and In re: Ethicon, Inc. (MDL No. 2327).
Mr. Grand has also been appointed Co-Liaison Counsel in two multicounty litigations underway in New Jersey Superior Court for vaginal mesh lawsuits involving products marketed by C.R. Bard and Ethicon. He was also a member of the Plaintiff’s trial team on the first Ethicon trial in that proceeding, which ended in March with a jury awarding $11 million in compensatory and punitive damages to a woman who was harmed by the Ethicon Gynecare Prolift device.
