Los Angeles - Matthew Moore is suing his doctor and his medical network after they allegedly ignored his complaint about notations in his medical records indicating that he was suffering from homosexual behavior.
Last year after reviewing his medical records, Moore found that he had the designation 302.0 listed in his file. The code was used to denote “Sexual Orientation Disturbance” in patients. The code is alleged to have been placed in his records by Dr. Elaine Jones during a routine checkup. Moore says he complained at the time and nothing was done. He added that his doctor told him that the
medical community goes 'back and forth'
on the issue of whether or not homosexuality is disease. Code 302.0 was removed from the Diagnostic and Statistical Manual of Mental Disorders more than 40 years ago, and has not returned. The doctor’s defense is questioned by many who note that she is not a mental health professional, nor does she seem to know that Code 302.0 doesn’t simply identify someone as a homosexual. It denotes a patient’s internal psychological issue with being gay or the patient’s desire to change their orientation.
This Position Paper on the subject, approved in 1973, states:
This diagnostic category is distinguished from homosexuality, which by itself does not constitute a psychiatric disorder.
Moore is openly and happily gay, and described the diagnosis as
another attempt by this doctor and this medical group to impose their agenda of discrimination and hate onto a gay patient.
The medical group Moore is referring to is Torrance Memorial Physicians Network, which blamed the error on complex software. Moore is seeking compensation and punitive damages in his lawsuit. He said
I don’t want any gay, lesbian, transgender, or bisexual ever to hear from a doctor that their normal and healthy sexuality is anything other than that.
