Cleveland - A 12-year-old boy playing with a replica gun died Sunday after being shot by a Cleveland police officer responding to a 911 call about a person waving a gun in the park.
Ed Tomba, deputy chief, said the officer fired two times after the boy pulled the fake gun on him, which was lacking the orange safety indicator that is usually found on the muzzle.
The 12-year-old boy did not make any verbal threats nor point the gun at the officer, but he reached into the waistband of his jeans and grabbed the fake gun after being told to raise his hands.
Tomba explained that is when the officer shot the boy twice, which led to the boy dying.
The shooting happened Saturday after the police responded to reports of a male with a gun in the park. The man who called 911 told dispatchers that there was a young boy at the recreation center pointing a pistol that was “more than likely fake” and scaring the other guests.
Police said the fake weapon was an “airsoft” type imitation gun that looked very similar to a semi-automatic pistol. However, the orange safety indicator had been removed, according to the police.

The president of the Cleveland Police Patrolmen’s Association, Jeff Follmer, said the officers were not told that the caller thought the gun may be fake. The officer that was called to the park saw the pistol sitting on the table, and watched the young boy grab it and put it in his pants.
Timothy Kucharski, an attorney said the boy went to the park with a few friends Saturday afternoon, but he did not know all of the details of what led to the shooting. He doesn’t know what would make a rush to judge.
He stated that he will need to talk to more witnesses and get more facts, so he can ultimately find out the entire story.
According to Fox 8, one officer involved in the shooting was taken to a local hospital where he was treated for an injury to his ankle.
Furthermore, both of the officers involved in the shooting will be placed on administrative leave as it is protocol in officer-involved shooting incidents.
