A mother says that her seven-year-old son is old enough to go to the park alone, but St. Lucie, FL, police disagree with her. She now faces a charge of child neglect.
Nicole Gainey says that she is dumbfounded by the entire situation, and says that she did nothing wrong.
The incident occurred last week when Gainey gave her seven-year-old son permission to walk from their house to the park.
According to Washington Times, the park is located about a half-mile from Gainey's home, and her son said it took him 10-15 minutes to get to it.
According to WTSP, the child passed by a public school on the way to the park, and someone noticed he wasn't with an adult, so they asked where his mother was.
The child said that he was asked a couple of questions and he got scared. He continued to say he just ran off and went to the park, and then the cops were called.
When police pulled into the park, they found him playing with other kids and then took him home. That's when Gainey was arrested and charged with child neglect.
The officer wrote in the report that the child was a the park without any supervision and that numerous sex offenders live within the area. Gainey said that she thinks her child is mature enough to go to the park alone and that he always has a cell phone on him.
Gainey is planning to fight the charge, but she said she will not allow her kid to go to the park alone because she does not want to be arrested again.
According to the State's Attorney's Office, there is no specific law that states how old a child has to be to go somewhere alone, and that it is done on a case-by-case basis.
