A man in Canada, was convicted by a court in Winnipeg of sexually assaulting a 103-year-old woman in a nursing home. He had an excuse, it was just a hug, he said, but witnesses say they saw him stick a hand down her top and pants.

At the trial, it ended on Wednesday, staff told the court that they entered a dining area and could clearly see 54-year-old Barry Wendel with one hand down the elderly woman's bra and another down the front of her pants.
For six months Wendel regularly visited the Tuxedo Villa home for the elderly but he would come to visit another resident. However, he also began to spend time with the woman the court has now convicted him of committing the sexual assault on.
He claimed that on the occasion of her 103rd birthday she asked him to give her a "good hug" and another time they hugged she whispered she wanted to have sex with him. On the occasion of still another hug he claims she exposed her breasts. "Women flirt, you know," he told the court. He had been barred from entering her room.
Abuse of elderly woman
Judge Sid Lerner said the witnesses had no motivation to lie and he believed their testimony. As to the testimony of Mr. Wendel, the judge was not impressed and he addressed the claims that the victim had initiated the entire thing, finding it highly unlikely. Either way he found it a case of elder abuse.
"If it did not occur, then clearly Mr. Wendel has contrived it as an explanation for the nature of his subsequent interaction with the victim," the judge told the court. "If some or all of this behaviour did occur, then clearly Mr. Wendel's reaction to it was disturbingly inappropriate."
The judge also noted that a doctor who testified said the victim was cognitively impaired and could not have consented to such an encounter in any case. "It cannot be the case that a 103-year-old woman would knowingly consent to having sexual acts performed upon her by a casual acquaintance in a public place," Judge Lerner said.
Sentencing is not until March.
