Chicago - Alberto Garcia, 27, is being accused of hiding his cellphone to videotape his girlfriend's 12-year-old daughter in the bathroom at the home they shared.
At a bond hearing on Friday, prosecutors said Garcia went into the bathroom at the home he shares with the child's mother and activated his video recorder on his phone. He then placed his phone in a trash can and put toilet paper around it to hide it.
The incident occurred on Tuesday. The woman's 9-year-old son entered the bathroom, urinated and left, but the boy didn't notice the camera. Later on, the daughter was recorded entering the bathroom and using the toilet. She heard a noise from the trash can and she found the phone.
The recording was stopped after the daughter discovered the phone. The recording didn't show the daughter nor the son below the waist.
Police were called after the girl brought the phone to her grandmother, who told the mother. The mother called police when she was notified by the grandmother.
In July, the girl found Garcia's phone in a hamper. The phone was in the bathroom, and there was a video on the phone that showed her naked in the bathroom, entering the shower, as well as getting out of the shower.
The video was deleted by the girl, and she told a school official about it. However, the investigation was closed, and Garcia denied any wrongdoing.
On Wednesday, after Garcia was arrested he admitted that he was recording the girl because he was sexually attracted to her. He said he had deleted 4-5 videos of the girl.
Garcia is facing child pornography and unlawful videotaping charges. The court set his bond at $200,000.
Prosecutors said Garcia's phone was sent to a forensic laboratory to attempt to recover the videos that were deleted.
