A cannabidiol hemp oil used by thousands of Americans for a variety of medical purposes, including the control of seizures in children, has now been designated a Schedule I controlled substance by the U.S. Drug Enforcement Administration (DEA).
Schedule I drugs, which include heroin, LSD and others, "are defined as drugs with no currently accepted medical use and a high potential for abuse," the DEA says on its website. This definition now puts CBD hemp oil into the same drug category as marijuana.
The feds announcement was published in the Federal Register December 14, 2016, and the new rule will become effective on January 13, 2017. CBD hemp oil was given a new code number for "marijuana extract" and includes any "extract containing one or more cannabinoids ... derived from any plant of the genus Cannabis."
This move by the DEA is a crushing blow to families who use cannabidiol hemp oil to control seizures in their children. This is also a harsh move because the amount of the active ingredient, THC in CBD hemp oil is very small, between 0.3 percent and 1.0 percent.
The CBD oil has been widely available on the Internet, via mail order, and companies have been selling the CBD oil under an assumed legality because of the oil's low THC levels. According to Leafly, the law may seem to be murky but the DEA says, “For practical purposes, all extracts that contain CBD will also contain at least small amounts of other cannabinoids."
In other words, the DEA is saying all CBD oil is illegal and now a schedule I controlled substance. Why did they do this, some people might ask. The DEA says the move was meant to bring the US into compliance with international drug-control treaties.
This writer just has to add this — if the DEA is so concerned about international drug treaties, why haven't they done anything about all the potent, highly dangerous synthetic drugs being shipped via the Internet from China? These drugs are killing off Americans by the thousands, while CBD hemp oil hasn't killed anyone.
