If you purchased StarKist tuna anytime between Feb. 19, 2009, and Oct. 31, 2014, you can thank a California man who filed a class action lawsuit in February 2013 against the company because he claimed the cans of StarKist tuna did not have adequate tuna as advertised.
The lawsuit claimed that StarKist “under-filled” some of the company’s 5-ounce canned tuna products in violation of state and federal law. This was considered “false advertising” by the plaintiff, Patrick Hendricks of Oakland, California. Hendricks filed the claim as a class-action lawsuit on behalf of himself and a “nationwide class of purchasers of StarKist tuna.”
In July of this year, a federal court judge gave preliminary approval to an agreement between Hendricks and StarKist where StarKist did not admit to any wrongdoing, nor was a ruling handed down in favor of the plaintiff. Instead, StarKist agreed to a proposed settlement that included consumers filing a claim and having the choice of receiving $25 in cash or $50 in StarKist coupons.
This was done to avoid a long and expensive trial. A final fairness hearing is scheduled for December 17, 2015. Consumers need to know there is a November 20, 2015 claim filing deadline for claims.
