In a letter to Attorney General Alberto Gonzales, U.S. Rep. Walter B. Jones said Nifong may have engaged in prosecutorial misconduct and violated the civil rights of the three lacrosse players charged with raping an escort service dancer hired to dance at a team party in March.
Three former players, Dave Evans, 23, of Bethesda, Md.; Collin Finnerty, 20, of Garden City, N.Y.; and Reade Seligmann, 20, of Essex Fells, N.J., are charged with rape, kidnapping and sexual offense.
Nifong has come under intense criticism for his handling of the case. Jones, a Farmville Republican, said he was concerned that Nifong directed the Durham Police Department to conduct a photo identification procedure that violated the department's guidelines.
In the lineup they only had pictures of Lacrosse players from Duke, no dummy photos thrown in..in the first time around the 'victim' said she didn't recognize anyone, the second time around (with the photos cut down) she chose the three men..one of which had left before the alleged rape even took place.
Jones also complained that Nifong's numerous public statements in the early stages of the case prejudiced the community against the players.
"Mr. Nifong's statements ranged from labeling the Duke players hooligans' to falsely stating that they refused to cooperate with his investigation," Jones said...the players actually came down willingly and answered all questions, even giving DNA samples (which turned up nothing).
The attorney (read: leader of the witch hunt) has discarded video, photo, and eye witness acounts (from other players and a fellow stripper [her testimony rebuffs almost all of the 'victims'])...
The sad thing is that he doesn't care about the woman who was supposedly raped, he simply went after the kids because he was in the middle of an election in a primarily black neighborhood..he wanted to get their vote, he didn't care about justice.
*note, a lot of the facts I used came from an episode of 60 minutes..not in the article ;) *
