DaimlerChrysler AG was ordered by a jury to pay $20 million (U.S.) to a retired police officer and brake repair worker whose right lung was removed because of cancer caused by asbestos.
The were found to be liable for 10 per cent for D'Ulisse's cancer. It is also responsible for 80 percent of the damages because two other companies found to be liable are no longer around.
DaimlerChrysler is appealing the ruling because they say the case was built on "junk science" and accused Justice Louis B. York of "improper rulings."
Two other auto manufacturers settled before the trial for unknown amounts.
DaimlerChrysler is claiming that Colella's cancer was caused by radiation therapy after he contracted Hodgkin's lymphoma in the 1970s.
