If you are thinking of following "The 12 Days of Christmas" gift buying model for your true love, think again, because you may be subjecting your significant other to additional government oversight.
President Obama's signature law, Obamacare, also known as the Affordable Care Act, requires that any entity that has 50 or more full-time employees, must provide healthcare for their workers.
Of course, the Employer Mandate provision like many other parts of the law has been postponed until 2015.
But there are still many unanswered questions regarding the Employer Mandate including whether a volunteer is considered an employee.
According to the Sunshine State News, the Department of Labor considers volunteers as non-employees, but the IRS “considers all volunteer firefighters and emergency medical personnel to be employees of their departments.”
Since the IRS plays a big role in enforcing Obamacare rules, volunteer emergency personnel may not be exempt.
There are 13 shopping days till Christmas; so, for those that like to plan ahead, I offer you this tidbit of advice.
I was leaning towards doing something out of the ordinary this year. I was seriously considering giving my true love the gifts from "The 12 Days of Christmas" beginning with the Partridge in a Pear tree on Christmas day. I imagined I could find all of the items on Ebay or Amazon.
But, when I added up the 8 maids, 9 ladies, 10 lords, 11 pipers, and 12 drummers, it is exactly 50 workers; that would make my wife a large scale employer! Plus she would have to hire workers to take care of all the darn birds.
I really wanted to surprise the love of my life and considered contacting the IRS about my dilemma but decided I did not want to invite any unnecessary attention.
So honey, until Obamacare is all sorted out, you will just have to settle for a normal Christmas gift!
