An interrogation over his toy cap gun led the child to wet himself but his suspension is now being reversed and will not appear on his record.
Thanks to some passionate parents who hired a lawyer and fought the school system, the five year old in Maryland who was punished for a toy cap gun will not have the incident on his permanent record.
Superintendent Jack R. Smith sent out a letter to the family's attorney in which he explained that the incident will be cleared entirely from the Kindergartener's record.
The incident occurred in May when the child was interrogated for two hours and suspended for ten days after showing his toy cap gun to a friend on the school bus.
Several similar instances have occurred recently, especially following the mass shootings at Sandy Hook Elementary and the Aurora theater. Two second graders were suspended in May after they made shooting noises and pointed their pencils at one another and one school offered counseling to students who were "upset" by a strawberry toaster pastry that was shaped into a gun.
