article image'Unflushed toilet' leads to passenger being detained

A passenger on a Virgin flight said that he was detained after a member of the cabin crew accused him of not flushing the toilet.
According to News, Salvatore Bevivino, 52, is suing Virgin America for half a million dollars in damages. Bevivino says that the incident has left him feeling humiliated.
According to MSNNow, Bevivino says that the incident, which occurred last April, started when he could not get a flight attendant to bring him a soda.
According to The Smoking Gun, Bevivino said that the flight attendant told him that he had to enter his drink request on the in-flight entertainment unit, and that was when he asked why the attendant could not bring him a drink like other attendants on other airlines do. Bevivino then said that he told the attendant that his time was precious and that the attendant was there to serve him.
A crew member eventually brought him a drink after he informed the staff that he was going to contact the airline about the policy.
When the plane landed in San Francisco, Bevivino was pulled aside "as a person of suspicion" and he was accused of not flushing the toilet. The police, FBI and security agents escorted him off of the plane.
The police incident report says that a flight attendant said that Bevivino went to the bathroom, asking for a drink and when he came out of the bathroom he was smiling and started swearing. The incident report went on and said that the attendant went by the restroom and saw that the door was left open and the toilet was not flushed.
Bevivino says that he was not swearing but he was just a little flustered over the incident.
