Purchase - Frito-Lay has come out with a new line of what it calls "All Natural" Artisanal corn chips. These include Tostitos and SunChips. Now, a class action lawsuit against the company claims the chips actually contain dangerous genetically modified oils.
The suit, filed by Milberg LLP, says Frito-Lay is misleading the public by claiming right on the bag that Tostitos and SunChips are "made with all natural" ingredients. The lawsuit states,
"The reasonable consumer assumes that seeds created by swapping genetic material across species to exhibit traits not naturally theirs are not 'all natural."
The Huffington Post reports that although Milberg's suit makes a good point, it may be a tough case to win. The U.S. Food and Drug Administration defines the term "natural," as "ingredients extracted directly from plants or animal products as opposed to being produced synthetically." But since this whole issue is unregulated, it does not include ingredients made from GMOs or organisms whose genetic material has been modified, especially by genetic engineering.
Add to this, The Gothamist reports that In 1993, the FDA issued a regulation that said it isn't misleading to call something "all-natural" when
"Nothing artificial or synthetic (including color additives regardless of source) has been included in, or has been added to, a food that would not normally be expected to be in the food."
Ingredients in processed foods that contain GMOs do not currently have to be listed. And PepsiCo, Frito-Lay's owner, uses genetically-modified sweeteners (high fructose corn syrup) in its soft drinks, and that fact doesn't show up on the label.
Milberg LLP also brought a class-action suit last August against ConAgra, arguing that its line of Wesson oils can't be "all-natural" since the oil contains GMOs. The process of genetic modification is in fact unnatural, the suit claims, which should nullify the term "all-natural."
Milberg LLP, is a law firm that focuses on defending the rights of victims of corporate and other large-scale wrongdoing.
