New Glasgow - A Nova Scotia man was sentenced to house arrest for using his mobile phone to video record patrons of a tanning salon in a change room.
Russell Alexander Wile, 34, of New Glasgow, went to the Coco Beach Tanning Salon on July 7 as a customer. While there he hid his iPhone behind a poster which had holes poked through it. An app made the phone begin recording when there was motion in front of it.
CTV reported that 14 people used the room before the phone was discovered by staff and handed over to police.
According to the New Glasgow News, Wile told police that he had always had an interest in adult material, and had previously made hidden-camera videos of his ex-girlfriend and one of her friends in the bathroom at his house. He claimed he had never made any recordings in a public place before.
Wile entered a guilty plea to voyeurism and was sentenced to six months under house arrest. He was also ordered to pay a $100 fine, submit a DNA sample, avoid alcohol or drugs, agree to electronic monitoring, attend counselling, and to stay away from tanning salons and public change rooms.
He has been banned from accessing the Internet and from having any device which can download videos or other images.
The tanning salon had requested restitution, claiming Wile's actions cost the business more than $8,400. That request was denied because there were no financial documents to support it, and the judge added that Wile would not be able to pay it anyway, as he is unemployed.
There have been other cases involving spying on people in tanning salons. In 2008, the operator of a tanning salon in Virginia was sentenced to 15 days in jail and fined $250 for peeping at a nude customer by sliding a mirror under a door.
Earlier this year, a woman in Utah reported that she was getting dressed after tanning when she looked up and saw a video camera phone aimed over the partition at her.
