Benjamin Barton, unable to contact Amy Ogden, the 'apple of his eye' in the week before Valentines Day, ten months ago. Convinced she was dead he broke into a hospital mortuary to find her body and express his undying love once more.
Benjamin Barton, aged 24, of Bognor Regis, West Sussex, learned late last week at Southampton Crown Court (U.K.) what an extreme Valentine's Day expression of love would cost him.
He had fallen for Amy Ogdon, when he met her at a Christian Union meeting at Southampton University.
Hampshire police spokesman Ian Sainsbury said at a press conference,:
Barton went into the mortuary looking for Ms Ogden... He kicked the main door in and then used the axe to get into the mortuary. He said he then checked records before going to the drawers containing the unidentified bodies and looked at them to see if they were her. When he finally became convinced she wasn't there he left.
Police identified, traced and apprehended him quickly. They found a wealth of physical evidence including documents, keys, an axe, a chisel and two hammers in his room.
Nathan Rasiah offered a portrait of an entirely different young man. He testified to the defendant's character saying Barton "had been an accomplished student ... quiet, studious, well mannered and trustworthy."
DigitalJournal reports he also offered a tempered opinion of the essence of the offense, "In no way did he search the mortuary for gratification. He was labouring under the misapprehension that the girl he loved was dead. There was no menace, no violence was directed towards any person."
The Solomon of Southampton heard both pictures. Barton was held liable for damages and pleaded guilty to the lesser of the two charges he faced. Significantly, this deal included a guarantee that he would not be incarcerated.
He was ordered to pay £1,000 compensation. He was placed under supervision for 12 months on the condition and further ordered to pursue medical help for nine months.
The Independent reports that Barton's tragic feelings for Ms Ogden were unrequited. In other words, 'dead or alive' it would have been a date disaster on the most romantic day of the year.
