After being charged with a capital murder crime, Casey Anthony has a new attorney to defend her. She's accused of killing her young child Caylee whose body was found in December. Her new attorney says the state has no grounds to seek the death penalty.
The new attorney Andrea Lyon makes it clear that she intends to fight the state with respect to not only the case itself but the grounds upon which it seeks the death penalty for Casey Anthony if she is indeed convicted of the crime of killing her young daughter. Caylee Anthony went missing last summer. Her mother Casey reported her missing one month later. After months of searching, authorities found the body of two-year-old Caylee in December not far from the home of George and Cindy Anthony, the child's grandparents.
Andrea Lyon is called “the Angel of death row" because she has aided a number of people from being given the death penalty. In fact it is been said that she is never lost a death penalty case.
The Orlando Sentinel, the newspaper that has been following this case and has a special section devoted to tracking it, quotes Leon as saying, ”There is no question in my mind that they are seeking a tactical advantage, and I intend to say so bluntly and in front of this court. She went on to say, “ I believe that the Florida law simply doesn't allow asking for the death penalty in these circumstances.”
In recent developments, as José Baez attempted to get phone records and was refused because he didn't file the proper paperwork, Casey Anthony was said to be quote all business while her mother Cindy Anthony became emotional and wrote several notes to her lawyers.
Television media in Florida interviewed José Baez who declared that he will continue his fight to stop jailhouse video made of Casey Anthony reaction upon hearing that the body of her daughter had been found. He maintains that he can convince the court to make sure the public never has an opportunity to see the video recording.
CNN reported that the State of Florida made a dramatic reversal from its original position on seeking the death penalty for Casey Anthony, declaring it to be an appropriate penalty if Casey is convicted of killing her daughter. It was observed then that this decision about the potential for the death penalty for Casey Anthony if found guilty might have a major impact on the trial itself.. Defense attorneys have sought a number of changes that will delay the eventual trial, according to reports.
