A man left his mobile phone with nude photos of his wife in a McDonald’s restaurant. After, someone posted the pictures online, including the man's address and phone number. He and his wife are now suing McDonald’s for damages.
Philip Sherman left his phone at a McDonald’s in Fayetteville, Arkansas in early July. When he called them back about the phone, the staff assured him they would keep the phone safe for him.
But his wife later discovered nude photos she previously sent to her husband were now available online. They were also receiving offensive calls and text messages about pictures.
The Shermans claim they had to move to a new home because of harassing calls.
They are now suing McDonald’s Corporation, the McDonald’s franchise owner and the restaurant manager for suffering emotional distress, embarrassment and damage to their reputations. They are also seeking damages for lost earnings and the costs of moving to a new home.
So far, McDonald’s has not commented on the case. The nude pictures have been removed from the site on which they were posted.
McDonald’s is not being blamed, nor the franchise, for the incident; the suit singles out the staff who promised to hold the phone safely.
