Britney Spears has agreed to give up the custody battle with ex-husband Kevin Federline. The couple's two sons will live with their father who now has sole legal and physical custody of the boys.
Federline was granted temporary custody of Jayden James and Sean Preston in October as Spears grew increasingly out of control. Friday's agreement eliminates the need for a custody trial. Family courts prefer that parents work out custody issues. The case still has to be filed to Los Angeles Superior Court Commissioner Scott Gordon. Gordon met with the lawyers on Friday but did not issue a ruling or take up the case in open court.

Ms. Spears will have visitation rights. At this time she has monitored visitation with the boys two days a week and one overnight visit. Early in the year the star's parental rights were taken away after mental health issues.

The child support Spears will be paying has been upped to $20,000 a month from $15,000.

Mr Kaplan said: 'The case has been settled. The court still has to approve it. All the issues that would have been addressed at trial have been settled. Orders now in place will stay in place.'


The agreement allows the troubled singer to have more time with her sons. It has been said that Federline wants Spears to be a co-parent of the children.

While the children are under the age of eighteen it is possible that the status of who has custody can change.

    These poor kids...they'll have everything materially, but what about mentally and emotionally?

    If she was my daughter Id have kicked her up the a55 ages ago !

    As Debra says, the real losers in all this are the kids, can you imagine when they are of an age to use the .net and find out whats been going on with their parents ...

    im sorry but i honestly can not respect a woman who would give up her kids to a jobless looser. i lost all respect for this piece of trash of a mother.

    KJ -- I hope that you don't think that I was belittling Federline...I'm just concerned over the children receiving the nurturing they need...I know how confusing it can get for children to have to go between parents...as is ordered via the courts. If Federline was not fit to be a father to his children, then I'm sure that the court would have ruled otherwise, regardless of the jing-jing in his pockets.

    I hope Federline proves that he will be a good father to the kids but will definitely be better than Britney.

    Deb I used to think this guy was a jerk but since he has had those kids I have done a 180. His priority has been the boys and keeping their mother in their lives.

    My partner was a single dad for 6 years. Dads can nurture just as well as mothers.

    That's on the line of what I meant. These children come from high profile parents and that's got to be hard enough.

    Have you really seen much of the boys since Federline has gained custody? The photos that have been in the news have on a much larger scale have been with their mother. We won't know until they are much older if they are being reared 'right' but then again that goes for all families doesn't it?

    Yes it does. So much of our parenting skills are dependent on how were raised. Federline must be doing something right or he wouldn't have gotten full custody.
