The State of New York is moving ahead and suing two pharmacies for selling out-dated foods, medications and baby formula. After an intense investigation, 142 CVS Stores and 112 Rite Aid stores were found to be selling a variety of expired items.

WETM reports that the lawsuit comes weeks after it had been learned that these stores were allegedly selling outdated products and an
investigation of all CVS and Rite Aid stores was initiated.
During the investigation, undercover agents purchased over 600 different, expired products, many that had been expired for over a year. But don't breathe a sigh of relief yet. These two stores are the "worst" offenders, which is why only CVS and Rite Aid are named in the lawsuit.
The probe found that 60 percent of CVS stores visited had expired items and 43 percent of the Rite Aid stores had expired products.
The expired products included items like milk, eggs, medicines and baby formula. Even after being warned by the state, these pharmacies allegedly continued to sell expired products.
"It's a double whammy for the consumer," Attorney General Andrew Cuomo said. "You're not getting what you paid for in the first place, and you may be buying a product that is ineffective or, even worse, is harmful."
Spokespeople from both chains said that they have ordered their stores to pull all outdated products as well as retrain their staff on their specific store policies.
The lawsuit brought about by Attorney General Andrew Cuomo will focus on federal, state and local laws that are there to protect consumers.
