Breaking News: This just off of the CNN news feed: The State of Texas Appeals Court has ruled that the 460+ children removed from the FLDS compound should not have been taken. 38 women had taken their plea to the appeals court and won.
The 460+ children were removed from the Yearning for Zion (YFZ) Ranch in Eldorado, Texas last month and have since been held in state custody. As of yet, no formal charges have been filed in the case.
Texas 3rd District Court of Appeals just ruled moments ago that the children should not have been removed from the home, citing a lack of sufficient evidence for the "extreme" measures taken by Texas authorities.
85 women of the YFZ Ranch had plead their case to the appeals court, asking for their children to be returned.
"The legislature has required that there be evidence to support a finding that there is a danger to the physical health or safety of the children in question and that the need for protection is urgent and warrants immediate removal," the ruling said.
It continued, "Evidence that children raised in this particular environment may someday have their physical health and safety threatened is not evidence that the danger is imminent enough to warrant invoking the extreme measure of immediate removal prior to full litigation of the issue."
