In Virginia, those who are convicted of French kissing a minor under the age of 13 years will now be guilty of a Class 1 Misdemeanor and will be required to register as a sex offender in an overwhelming majority vote.
In a 96-1 House and 39-0 Senate General Assembly vote on Saturday March 8, 2008, anyone convicted of using their tongue while kissing a minor who is under the age of 13 will face up to 1 year in prison and a fine up to $2,500 US,
according to a news report. They will also be required to register as a sex offender.
Delegate Riley Ingram (R), Hopewell, VA, introduced legislation for this law on behalf of a mother whose 10-year-old daughter had been tongue-kissed by the husband of her baby sitter.
At the time of the incident, the only crime he could be charged with was
Contributing to the Delinquency of A Minor.
Members of the House fought to make the law a Class 6 Felony offense, which would have been punishable by up to 5 years in prison and up to $2,500 US. The Senate felt this punishment too harsh and in the final days, the House conceded to the lesser offense.
Delegate Phillip Hamilton (R), Newport News, VA cast the only vote in opposition.
"I think that type of behavior is so egregious it warrants a felony," Hamilton said.
It is now headed to Governor Tim Kaine for approval.
