A student is suing Burger King after he ate a Burger King Whopper sandwich and bit a piece of condom, he said, found inside the sandwich. He is suing Burger King for damages, pain and suffering.
Van Miguel Hartless, a student at Green Mountain College in Poultney, bought a Whopper sandwich from Burger King. On the third bite, he says he noticed an unwrapped condom in the sandwich.
He said the whole experience was a nightmare for him. He talked about it to the press and said:
"As I went to bite down a little harder, I felt a rubber grind in between my teeth. I saw it half in my mouth, half hanging out. It was an immediate sick-to-my-stomach type of thing."
Hartless contacted a lawyer after this incident and is now suing Carrols Corporation, the owner of Burger King, for damages for pain and suffering, emotional duress and medical expenses.
Hartless says this incident happened more than three weeks ago, and since that time he said he is suffering from vomiting, and is worried the condom may have been used. He said he has paid for various medical tests.
Hartless also went through a lie detector test. According to his lawyer, he passed the test with flying colors.
Burger King denies that any of its employees placed the condom in the burger and will fight the lawsuit.
Hartless has kept the sandwich and the condom as evidence. He said he didn’t want to file a lawsuit, but just wanted to make sure Burger King will cover his medical bills if complications arise after this experience.
