Her sex life was breaching the peace and disrupting the sleep of her neighbors. So just a few short months after moving into her Nuremberg apartment, a woman was evicted on the basis of being a noisy tenant.
Alenka Schmidt, 34-year-old mother of two, was shocked to receive an eviction notice from her landlady,
citing that:
Neighbours, not just where you live but in adjacent houses, complained of regularly, clearly sexually motivated, loud disturbances of the peace.
That was enough to get Schmidt evicted as it is considered a serious offence to be a noisy
tenant under German law.
One neighbor claimed Schmidt had sex quite frequently every week to the point where it was impossible to get an undisturbed night's sleep.
Though Schmidt conceded there may have been occasions when she was a little loud, she
insists it was
not so loud that everyone in the house could hear. My boyfriend and I had totally normal sex.
Schmidt believes the fuss is really a generation gap issue.
The old fogies simply don't approve of the way I live. They condemned me as soon as I put down my shutters at night.
Alenka has moved out of her apartment for now but vows to fight the eviction in court.
