Did Avril Lavigne Steal Tune From Rubinoos?

Avril Lavigne's hit song "Girlfriend" is coming under fire in a lawsuit by the members of a 1970's rock band, The Rubinoos, who claim she stole that tune from their original 1979 song, "I Wanna Be Your Boyfriend."
Tommy Dunbar and James Gangwer filed a lawsuit against Lavigne and her co-writers for ripping off the song they wrote for their own band almost three decades ago.
"We are not so naive as to chalk it up to some sort of cosmic coincidence," Dunbar said Thursday. "The lyric, the meter, the rhythm - they're identical."
The two sides are scheduled to be in the Oakland, California court on August 28.
A music critic for Billboard magazine has also stated that Lavigne's chorus on "Girlfriend" was a "total lift from the Rubinoos' 'I Wanna Be Your Boyfriend.'"
No one from Lavigne's side of the battle is speaking yet. It should be interesting how this plays out.
