Duke Case Prosecutor Disbarred

By Oliver VanDervoort     Jun 16, 2007 in Crime
A disciplinary committee announced that disgraced prosecutor Mike Nifong would be disbarred for his disastrous prosecution of three Duke University lacrosse players falsely accused of rape.
"This matter has been a fiasco. There's no doubt about it," said committee chairman F. Lane Williamson.
The committee, after a short deliberation, unanimously agreed with the bar on almost every charge - including the most serious allegations - that Nifong's actions involved "dishonesty, fraud, deceit and misrepresentation." Yesterday, Nifong announced he would resign, and said today, through his lawyer, that he would not appeal the decision
"He hopes this helps restore some of the confidence in the criminal justice system of North Carolina," Nifong's attorney said.
"On one hand, it's very devastating," he said. "On the other hand, he's been going through this process for a long time, so you always have some semblance of relief when the process is over with regardless of the outcome."
The State Bar prosecutor laid out a devastating case of wrongs, and misdeeds that Nifong had done throughout the leadup to the Duke trial. Including withholding evidence, and attempting to try the defendants through the media
"Mr. Nifong did not act as a minister of justice, but as a minister of injustice," the Prosecutor said
Nifong didn't appear surprised by the outcome, acknowledging during his testimony that he probably deserved to be punished for his "overzealousness"
Disciplinary committee chairman F. Lane Williamson also hinted during Saturday's closing arguments the three-member panel was likely to conclude that Nifong kept from the defense DNA test results that found genetic material from several men in the accuser's underwear and body, but none from any lacrosse player.
"It wasn't just one little oversight," the Prosecutor told the Panel "This was conduct over an extended period in a very high-profile case."
