A man with a history of disliking dogs and of walking around his yard with his gun, is accused of shooting a neighbours dog.
Michael Marino, 47, has been charged with misdemeanor wanton endangerment and violating a city ordinance for discharging a firearm within city limits. It is alleged that he shot a dog on April 1st of this year.
According to a signed criminal complaint, Mr. Marino has a history of not liking dogs and has been seen pulling out his gun on dogs in the neighborhood before.
On April 1st, it is being reported that witnesses saw Marino catch sight of the dog, go into his house and come back out with a .45-caliber pistol. While he was in the house, he called both the police and animal control, but did not wait for them to get to his home. Instead, he shot and killed the dog. According to the complaint, the witnesses say that the dog was not threatening anyone.
"Many neighbors are in fear of the defendant and his pattern of carrying a firearm and engaging in threatening behavior."
City hall has received "lots of calls" about the shooting said City Administrator Larry Klein. He reported that one female resident told council that on numerous occasions, Mr. Marion allegedly walked around his yard with his gun in plain view. Klein said another resident told council that she picked the dog up one time when it was wandering the neighborhood because she was afraid that Marino might shoot it.
Officials confirmed Marino has a valid concealed-carry license.
Marino's lawyer, Craig Kendrick, says: "Michael, his wife and children have been residents of Fort Wright since 1995. His wife describes him as a loving and caring husband. His three children know him as a great dad as well as their protector. Needless to say, the family is devastated by these allegations." Yes, it is always nice to have a protector who walks around his yard with his gun out and threatens the neighbourhood animals. What a loving, caring and isn't he setting an excellent example on how to be a great dad?
Kendrick said his client is presumed innocent and further facts surrounding this incident will come out at trial. Marion is scheduled to appear before a judge on Thursday.
Look, it appears that the owners of this dog just let it wander around and while I think that is not the best thing for any animal, I also do not think that people should be able to just shoot a dog because they don't like dogs. This shooting was in a family neighbourhood and anything could have happened.
