Anna Nicole's Last Will and Testament, a Focus of Law Schools

By myobservations     Mar 12, 2007 in Entertainment
Anna Nicole's untimely death a lesson for law school students.
The ramifications and legal problems related to Anna Nicole's life and untimely death can be directly attributed to the lack of preparedness of her will and testament and whether or not it will stand up in a court of law.
Law students across the nation have taken great interest in the Anna Nicole legal saga. Some students have obtained copies of her will and are openly discussing its legality.
According to Susan French, law professor at the University of California, "The students were asking right away _ 'When are we going to talk about Anna Nicole Smith?'" French has closely reviewed the will and points to the fact that Smith's daughter was born after the will was written. Also, Smith's son, whose name is included in the will died before Nicole, the supposed creator of the will.
There is a clause in Nicole's will that seems to disinherit future spouses and children. Professor Stephen Urice, who specializes in trusts and estates at the University of Miami, finds this to be very challenging for law classes. Why would such a clause be in Smith's will? It may well be the case of information carelessly copied from a standardized will and testament document. I wonder if Howard Stern had anything to do with that.
It has also been noted that Nicole's will does not provide for contingency planning. In the case of Anna Nicole's sudden death, a contingency plan would have been most beneficial.
