Supreme Court rejects the appeal of an Arizona man sentenced to 200 years jail for possessing Child porn images.
The US Supreme Court has refused to hear an appeal by a high school teacher from Arizona sentenced to 200 years in jail for possessing child pornography.
Morton Berger was earlier awarded a 200 year sentence by the Arizona court because he possessed 1000s of porn images of children in his computer. The court awarded 10 years for each of 20 images he possessed for a total of 200 years punishment. This sentence will be served continuously for a total of 200 years without the possibility of a parole. The Prosecutor originally asked for 340 years.
So Morton Berger appealed to Supreme Court and claimed the sentence was so disproportionate to his crime it breached the constitution.
If the case was originated either in a Federal court or any other state, he would have received a lighter sentence. But he was caught in Arizona which has the toughest laws on child abuse and exploitation.
Morton's stated to the Supreme Court that his punishment was much longer than that for a rape or even a second degree murder and his amounted to cruel and unusual punishment.
The Supreme Court refused to hear his appeal and gave no reason for its denial.
I am glad this person is put in Prison and will give a warning to everyone. But 200 years seems excessive, it is impractical. if they do the same for rape and sexual abuse I agree, but I don't think so that is the case.
