No Charges brought against Shooter in Rockford MN

Shooting, deemed Self defense, No charges will be brought to Eric Michael Cegon
30, of Rockford MN after fatal gunshots took the life of Erik Richtor.
On the evening of December 13th 2006 the wright county sheriffs office was notified of a fatal shooting involving Eric Cegon,30 and Erik Richtor 35 at the home of Samantha Simons.21 in Rockford MN
it all started in 2005 when Simon's decided she wanted to end her relationship with Richtor the father of her child. He did not take this well.On three occasions that year simons had applied for a restraining order against Richter. Eventually in April 2005 Richter was charged with Domestic Assault.
In 2006, Simons had moved on and started a relationship with Eric Cegon. Rictor made it very clear he was not happy with this. He expressed to her that if he couldn't have her no one could.
On November 4th 2006 Richter was charged with Terroristic threats and Criminal damage to property after trying to break into Cegon's home and smashing in all the windows of Cegon's car. There were also reports of verbal threats to Cegon's and Simon's life by Richter.
Richter then posted 10,000 in bail and was ordered not to possess any firearms. He was also not to have any contact with Cegon or Simon's. On December 6, 2006, Richter allegedly violated the no contact order when he went to Simon's’ residence in Rockford and threatened her with a knife. Richter reportedly wanted to get back together with Simon's Cegon was very upset about her relationship with Cegon and allegedly told her he was going to kill him. He left her residence. She notified the police and a pick up order for Richter was issued. Richter was due in court on the 13th of December for the Terroristic Threats and Criminal Damage to Property complaint.
On the night of December 12, 2006, Simon's and Cegon locked the door to her residence at 8852 Walnut Place in Rockford. They placed a small sofa in front of the door. They went to the bedroom with Simon's’ son, locked the bedroom door and placed a dresser in front of the door. Considering the recent history, Cegon had armed himself with a shotgun. They all went to bed. At approximately 3:30 a.m. on the 13th broke the door in went upstairs to Simon's bedroom and forced his way in. Cegon proceeded to shoot Richer twice with his shotgun killing him.
Richter was armed with a loaded Colt Model 1911 Combat Commander .45 ACP caliber semi-automatic handgun. The weapon had an extended magazine inserted and the hammer was in the “half cocked” position, Richter also had in his possession leg irons, handcuffs and four additional loaded magazines for his gun,
Wright County Attorney Tom Kelly has decided not to file charges. Stating “In this case, the state has the burden to prove beyond a reasonable doubt that Cegon was not justified in using deadly force. Based upon the above facts, I am unable to meet that burden, and, therefore, no criminal charges will be filed against Cegon,”
